These Terms and Conditions (“Terms”) govern your use of the Sashco, Inc. website (“Site”) and your purchase or use of Sashco products. Please read these Terms carefully before using this Site. If you do not agree with these Terms, do not use this Site.

Product Warranties

Sashco, Inc. Limited Lifetime Warranty (All Products Except Stains)

Sashco warrants this product will substantially meet published specifications on the date of sale. If it fails to do so, return the unused portion with the original sales receipt for replacement or refund, at Sashco’s sole option. These are the purchaser’s sole and exclusive remedies for any breach of warranty. Purchaser must determine the suitability of the product for purchaser’s specific needs and assumes all risk associated with its use. Sashco will not be liable for direct or indirect damages.

Except as stated above, there are no warranties for this product. The foregoing express warranty is in lieu of all other warranties, express or implied, including without limitation implied warranties of merchantability or fitness for a particular purpose, which warranties are specifically excluded and disclaimed.

This Limited Warranty gives you specific legal rights. You may have other rights which vary from state to state. Some states do not allow exclusion of implied warranties in consumer or other sales, limitations on the duration of implied warranties, or exclusion or limitation of incidental or consequential damages. The limitations or exclusions above may not apply to you depending on your specific circumstances.

Sashco, Inc. Limited Warranty (Stain Products)

Sashco warrants this product will substantially meet published specifications on the date of sale. If it fails to do so, return the unused portion with the original sales receipt for replacement or refund, at Sashco’s sole option. This is the purchaser’s sole and exclusive remedy. If you do not consent to any part of this Limited Warranty, including the following limitations and exclusions, you may return the unused, unopened product to Sashco within thirty (30) days of purchase, together with the original sales receipt, for a full refund of the purchase price. Purchaser must determine the suitability of this product for purchaser’s specific needs and assumes all risk associated with its use.

There are no warranties which extend beyond the description on the face hereof. To the extent permitted by law, the foregoing express Limited Warranty is in lieu of all other warranties, express or implied. Sashco makes no other warranty of any kind, whether express or implied, including without limitation any warranty of merchantability or fitness for a particular purpose, which warranties are specifically excluded and disclaimed.

To the extent allowed by law, except for the obligations specifically set forth in this Limited Warranty, in no event will Sashco be liable for direct, indirect, special, incidental, or consequential damages, whether based on contract, tort, or any other legal theory and whether advised of the possibility of such damages. In no event will Sashco’s damages under any legal theory exceed the price actually paid by purchaser for this product.

This Limited Warranty gives you specific legal rights. You may have other rights which vary from state to state in the United States, from province to province in Canada, and from country to country elsewhere in the world.

Some jurisdictions do not allow exclusion of implied warranties in consumer or other sales, limitations on the duration of implied warranties, or exclusion or limitation of incidental or consequential damages. The limitations or exclusions above may not apply to you depending on your specific circumstances. To the extent this Limited Warranty is inconsistent with local law, it shall be deemed modified to be consistent with such local law. The terms in this Limited Warranty, except to the extent lawfully permitted, do not exclude, restrict, or modify, and are in addition to, the mandatory statutory rights applicable to the sale of this product to such customers.

Submission of Photo, Text, Video, or Other Content

By submitting to Sashco, Inc. (“Sashco”) any photo, video, drawing, graphic image, audio, writing, or other humanly-perceivable information in any media (collectively “Content”), you grant to Sashco and its assigns, and their respective affiliates, subsidiaries, licensees, agents, contractors, and assigns, an irrevocable, transferable, perpetual, royalty-free license to use, reproduce, distribute, prepare derivative works of, publicly perform and display, transmit, publish, archive, and otherwise make unfettered use of the submitted Content in any and all media, whether now known or hereinafter invented, throughout the world and for any purpose. This includes, without limitation, the right to resize, crop, censor, filter, compress, edit, feature, caption, affix logos to, and otherwise alter, modify, append, or make use of the submitted Content.

By submitting any Content, you represent and warrant that: the Content is original and you are the owner of it; the Content does not and will not infringe upon any copyright, intellectual property, contractual, or other rights of any third party; the Content does not violate any person’s right of privacy or publicity; the Content is not defamatory; you have the right to grant all rights and licenses made by you to Sashco without obtaining any third party’s consent; the rights you convey are free and clear of any claims or encumbrances; and you do not and will not assert any moral rights in the Content.

You acknowledge and agree that Sashco has no obligation to post, display, or otherwise make publicly available any Content you submit, and may, in its sole discretion, remove, edit, modify, destroy, or delete any submitted Content.

You understand that any Content you submit may be available for public viewing, rating, review, and comment, and that comments or ratings you disagree with may be published or otherwise become associated with your Content. By submitting Content, you waive any right of privacy you may have with respect to that Content.

You agree to hold harmless and fully defend Sashco and its affiliates, subsidiaries, licensees, sponsors, agents, attorneys, and assigns from and against, and agree not to pursue, any claims arising in connection with Sashco’s authorized use of the Content.

Content submitted to Sashco becomes the property of Sashco, and Sashco has no obligation to preserve, return, or otherwise make available to you or others any Content so submitted.

Terms of Use

Information on this Site may contain technical inaccuracies or typographical errors and may be changed or updated without notice. Any reliance on inaccurate or outdated information, opinions, advice, or statements on this Site is at your sole risk. Sashco reserves the right, in its sole discretion, to correct any errors or omissions and to make changes to the Site, its materials, and the products, programs, services, or prices described on it, at any time without notice.

Warranty Disclaimer

Sashco does not warrant the accuracy, completeness, or reliability of any advice, opinion, statement, or other information displayed or distributed through the Site. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SASHCO DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR OTHER VIOLATION OF RIGHTS. Distributor/Dealer and Applicator Location Disclaimer

Sashco offers distributor/dealer and applicator location information as an informational service only; it is not an endorsement or recommendation of any listed company. Each listed company is independent from Sashco and not under Sashco’s control; Sashco accepts no responsibility for and disclaims any liability for the actions of listed companies. You should make your own independent evaluation before conducting business with any company. Distributor/dealer information was believed accurate when posted but may change without our knowledge. Limitation of Liability

Sashco makes no representation that materials on this Site are appropriate or available for use outside the United States, and access from territories where the Site’s content is illegal is prohibited. You may not use the Site or export its materials in violation of U.S. export laws and regulations. If you access this Site from outside the United States, you are responsible for compliance with local laws.

Feedback and Information

Any feedback you provide on this Site is deemed non-confidential, and Sashco is free to use it on an unrestricted basis. Do not send confidential or proprietary information to Sashco via the Site. Names of other actual companies and products mentioned may be trademarks of their respective owners.

Entire Agreement

These Terms represent the entire understanding relating to use of the Site and prevail over any prior or contemporaneous, conflicting, or additional communications. Sashco may revise these Terms at any time without notice by updating this posting, and may terminate, change, suspend, or discontinue any aspect of the Site — including availability of any feature — at any time. Sashco may impose limits on certain features or restrict your access without notice or liability, and may terminate the rights and licenses granted above; upon termination, you must immediately destroy all materials obtained from the Site.
